Terms and Conditions
Introduction
Thank you for choosing Hope Training College for your online training needs. This document outlines the Terms and Conditions that apply to any online training course with Hope Training College (hereafter known as the "course"). The Terms and Conditions also apply to your access to the infrastructure required to participate in the course (hereafter known as the "service").
Any legislation referred to in the Terms and Conditions of Use is Western Australian and Commonwealth legislation (as applicable).
Agreement to Terms and Conditions
Your access to the course and service is dependent on your acceptance of the Terms and Conditions outlined in this document.
By having access to the course and service, you agree to these Terms and Conditions.
If at any time you do not agree with these Terms and Conditions, you must immediately discontinue use of the course and service.
Amendments to Terms and Conditions
Hope Training College reserves the right to change the course and service Terms and Conditions at any time.
Right to Release Information to Third Parties
Your information is handled in accordance with the Privacy Act 1988 as described in Hope Training College's Privacy Policy.
In keeping with the Privacy Act 1988 and Hope Training College's Privacy Policy, Hope Training College reserves the right to disclose your information to:
The Australian Skills Quality Authority (ASQA) in fulfilment of Hope Training College's RTO (Registered Training Organisation) auditing requirements.
Regulatory bodies if the course is associated with state, territory or federal legislative requirements.
Registered Training Organisations who are identified as the organisation formally delivering the course.
Other third parties as required by Law.
Other third parties in direct relation to legal action or debt collection.
If you enrol using a group booking that is associated with a company/organisation, you authorise Hope Training College to disclose your personal details, progress and any course outcomes to that company/organisation.
Hope Training College has a right to collect, store and distribute unnamed user statistics that may be gathered during the course and/or service.
Content
All text, graphics, illustrations, animation, video, audio and software that make up the course and the service (hereafter collectively known as the "content") shall remain the property of Hope Training College and third party providers.
You agree to not copy, modify, redistribute or exploit the content in any way unless expressly permitted by Hope Training College.
With the exception of temporary files required to access the course or service, you agree not to store the content in any format or by any method.
You will not engage in activities that prevent other users from accessing the course and/or service.
Use of the Course and Service
The course and service shall remain the property of Hope Training College and third party providers.
You will not use the course and/or service contrary to their explicit and implicit purpose.
You will not modify, exploit or use the course and/or service in a way that is contrary to explicit and implicit course completion process and framework.
You will not exploit the course and/or service to gain personal information of other users.
You will not engage in activities that prevent other users from accessing the course and/or service.
User Responsibilities
As the user of the course, content and services, you are responsible for:
Protecting your user name and password from unauthorised use.
Ensuring all use of your account complies with the Terms and Conditions.
Any charges relating to Internet connections, computer usage charges and download charges arising from the use of the course and services.
Unauthorised Access and Abuse
You are required to report any occurrences of unauthorised access and abuse of the course and/or services to Hope Training College as soon as possible.
Hope Training College's Right To Suspend and Cancel
Hope Training College and/or the nominated Registered Training Organisation reserves the right to suspend and/or cancel your access to the course and/or service if you are found to contravene any of the Terms and Conditions.
Topic and RPL Assessment Assistance
You must not seek assistance in answering Topic or RPL assessment questions with the exception of assistance in translation and gaining understanding of questions posed.
You must not plagiarise or copy any other person's Topic or RPL assessment in part or whole, and must only submit work which is your own.
USI
From 1 January 2015 anyone undertaking nationally recognised training delivered by a registered training organisation must have a Unique Student Identifier (USI), which can be obtained while doing the course or from
www.usi.gov.au
.
Auditing
If completing a Nationally Recognised Unit of Competency online, you will be subject to an assurance audit as part of the course completion process.
As part of the audit process:
You will be contacted by an assurance auditor/assessor by phone, email or in person, as appropriate.
You will not be deemed as having successfully completed the course until after the assurance audit has been completed.
The delivery of course evidence will be delayed until the assurance audit has been completed.
If the assurance audit determines you have not undertaken the course yourself, or if you refuse to participate in the auditing process:
Hope Training College and/or the nominated Registered Training Organisation reserves the right to withhold issuing of all evidence of completion.
Hope Training College's and/or the nominated Registered Training Organisation records will reflect that you have not successfully completed the course.
If the assurance audit determines you did the course yourself, your evidence of completion will be processed for delivery as specified.
If you undertake a Nationally Recognised Unit of Competency online, you must complete and be subjected to Hope Training College's assurance audit process within 12 months of course enrolment. If this does not occur, you may need to redo the course.
Refunds
Refunds of payments will be at the discretion of Hope Training College and/or the nominated Registered Training Organisation.
Outstanding Payments
Hope Training College and/or the nominated Registered Training Organisation reserves the right to restrict participation in future courses for participants with outstanding payments until all payments owing to Hope Training College and/or the nominated Registered Training Organisation have been received.
Data and Information Security
Hope Training College and/or the nominated Registered Training Organisation does not guarantee the security of any data or information disclosed online. You accept the inherent security implications of dealing online over the Internet and will not hold Hope Training College and/or the nominated Registered Training Organisation or its agents or suppliers liable for any breach of security or any actions or results arising from any breach of security.
Service and Course Availability
While Hope Training College and/or the nominated Registered Training Organisation uses reasonable efforts to maximise system availability, you accept that scheduled and unscheduled systems outages may occur and release us from any liability arising as a result of such outages.
Delayed Delivery of Evidence of Completion
While Hope Training College and/or the nominated Registered Training Organisation uses reasonable efforts to initiate delivery of evidence of completion within stated timeframes, you accept a delay in delivery may occur and release us from any liability arising as a result of such delays.
To the maximum extent permitted by law, you agree to release our carriers from any liability relating to loss of, damage to, late delivery or non-delivery of any evidence of completion.
Overseas Students who hold an Australian Student Visa
In accordance with the Education Services for Overseas Students (ESOS) Act 2000, Hope Training College are not registered as a CRICOS provider so are unable to provide training to any overseas students who hold an Australian Student Visa. An overseas student is defined in Section 5 of the ESOS Act as a person (whether inside or outside Australia) who holds a student visa (as defined in regulation 1.03 of the Migration Regulations 1994), excluding:
a Subclass 576 (Foreign Affairs and Defence Sector) visa, or
a person who satisfies the secondary criteria, but not the primary criteria, under the Migration Regulations 1994 for the grant of the visa, or
a secondary exchange student within the meaning of the Migration Regulations 1994, or
an overseas student who has been approved under a scholarship scheme, or an exchange scheme, sponsored by the Commonwealth to undertake a course of study or training in Australia.
Students are required to disclose to Hope Training College prior to or on enrolment if they hold a Student Visa as defined in regulation 1.03 of the Migration Regulations 1994. If it is identified that a student holds a visa which falls within this category, Hope Training College will notify the student and their application for enrolment cannot be accepted. Regulation 1.03 of the Migration Regulations 1994 - "student visa " means any of the following subclasses of visa:
a Subclass 500 (Student) visa;
a Subclass 570 (Independent ELICOS Sector) visa;
a Subclass 572 (Vocational Education and Training Sector) visa;
a Subclass 573 (Higher Education Sector) visa;
a Subclass 574 (Postgraduate Research Sector) visa;
a Subclass 575 (Non-Award Sector) visa;
a Subclass 576 (Foreign Affairs or Defence Sector) visa.
By agreeing to these Terms and conditions, Students understand that it is their responsibility to provide correct and accurate information to Hope Training College if they are a Student Visa Holder prior to or at Enrolment and understand that they cannot complete training with Hope Training College if they meet the requirements as defined in the ESOS Act 2000.
